Agistment agreement terms, conditions and rates

 
CONDITIONS
 
1.      Piplyn Lodge undertakes to provide full care for the horse during its stay on the property including arranging and providing for the farrier, and the dentist, and administering drenches. Services will be invoiced to the owner’s account.
 
2.      Piplyn Lodge will arrange for veterinary attention when required, and in cases of emergency will contact the owner’s preferred vet after attempting to contact the owner.  If the preferred vet is an unavailable, Piplyn Lodge reserve the right to contact another vet if the injury or illness is deemed by Piplyn Lodge to require urgent attention.
 
3.      Where the owner is uncontactable and the mare requires urgent veterinary care, the owner agrees to cover all costs of veterinary treatment, including surgery if required. If the treatment costs amount to more than $__________ the owner gives permission to have the horse destroyed.                           Initial ________
 
4.      Piplyn Lodge will perform any follow up veterinary attention required for an injured animal as prescribed by a vet, e.g. administering antibiotic, bandaging wounds, etc.
 
5.      Piplyn Lodge will attend to minor veterinary needs as required, at the discretion of Piplyn Lodge, in consultation with the owner.
 
6.      Piplyn Lodge will conduct daily inspection of the horse and will maintain all paddocks in as safe a condition as practicable, and will conduct frequent inspection and maintenance of the paddock fencing.
 
7.      Piplyn Lodge accounts are due seven days from preparation and are to be paid in full by the due date. Accounts are prepared monthly. An account-keeping fee of $11 per month will be levied every month for overdue accounts.
 
8.      Where an account goes into arrears, the owner is responsible for any recovery costs for accounts not paid within these terms and will be invoiced accordingly. These recovery costs will include all commissions payable, court costs, solicitor’s costs and any other costs associated with the recovery of the account. Piplyn Lodge reserves the right to engage a cost recovery firm to facilitate payment of outstanding accounts.
 
9.      Piplyn Lodge reserves the right to alter, increase or waive any fees at any time and undertakes to provide 21 days notice to the owner of such changes.
 
10.Piplyn Lodge will consider a horse abandoned for any account more than 30 days in arrears, unless prior arrangement has been made with Piplyn Lodge. Piplyn Lodge will assume ownership of the abandoned horse and seek to recoup outstanding monies by the sale or other disposal of the horse at the discretion of Piplyn Lodge. Any monies produced by the sale of the horse in excess of the owner’s account balance become the property of Piplyn Lodge.
 
11.Where, in the opinion of Piplyn Lodge, the horse requires supplementary feeding beyond its current nutritional intake, Piplyn Lodge will seek the owner’s consent to undertake supplementary feeding. The type of feed will be discussed with the owner and purchased at the owner’s expense, to be invoiced on the monthly account.
 
12.It is the responsibility of the owner to advise Piplyn Lodge of any disease carried by the horse. Failure to notify Piplyn Lodge of a communicable disease carried by the horse that leads to illness of other horses on the property will render the owner liable for associated costs and damages resulting from that illness.
 
13.The owner is responsible for obtaining and maintaining any insurance coverage of the horse at all times.
 
14.Piplyn Lodge and its employees, agents and contractors are not liable to the owner or any other person as a result of, relating to or in any way arising out of death, injury, illness or disease of the horse, however caused, including (but not limited to) the negligence or default of Piplyn Lodge, its employees, agents or contractors, involving any act or failure to act including tests, procedures, treatments and medications. 
 

 

Rates

Daily charges for services provided vary from time to time; at the time of the agreement the rates are:

  • Full board $17.60
  • Pasture only $7.70
  • Stable $33.00
  • Intensive care $110 (eg orphan foal)
  • hay when required $6.75
